Action by the plaintiffs Laura Vandenack and George Vandenack against the defendant Burton L. Crosby, d/b/a Heavy Duty Wrecker
Service and Yorkshire Indemnity Company (Crosby's insurance carrier) to recover damages arising out of an automobile accident.
Upon application of the defendants, the Mutual Automobile Insurance Company of the Town of Herman, the insurer of George Vandenack's
automobile, was interpleaded as a defendant for purposes of filing a cross-complaint for contribution. The plaintiff Laura
Vandenack seeks no affirmative relief against either George Vandenack or his insurance carrier. Shortly after midnight on January 6, 1952, one Derks was driving his car westerly on Highways 54-57 northeast of Green Bay
in Brown county, and his car left the highway and ended up in the ditch on the north side of the road. The traveled portion
of the roadway was 22 feet of blacktop pavement with a travelable shoulder six feet in width. The Derks car, as it came to
rest, was in a snowbank some 12 to 15 feet north of the pavement facing northwesterly with the rear closer to the roadway
than the front. Derks phoned the defendant Crosby's wrecker service for help and one Clausen, an employee of Crossby, responded
to the call and came with a wrecker. Clausen approached from the west and stopped to take a view of the situation. He concluded
that the only practical way of getting the Derks car up onto the shoulder was to attach a cable to its rear and pull it out
backwards.
