Description

WORKMENS COMPENSATION ? PRESUMPTIONS ? LUMP SUM SETTLEMENTS. 1. Workmens Compensation ? Intention of act. Intention in enacting Workmens Compensation Act was that monthly payment plan provided should be rule and lump sum settlement exception. 2. Workmens Compensation ? Presumption of correctness. In workmens compensation proceeding, finding of Industrial Accident Board sustained by district court created presumption of correctness, and if supported by any credible evidence, would be affirmed. 3. Workmens Compensation ? Evidence supported findings. In workmens compensation proceeding by 70 year old kitchen helper for injuries consisting of collapse of 11th thoracic vertebra, wherein lump sum settlement was sought in order to hire full time nurse and companion for helper, and it was shown that burden of her care, except financially, fell on her son and that son had to hire for her a day companion who cooked for her and son, and other children claimed that it would be insufferable burden to care for her in their homes, evidence supported finding that monthly payments rather than lump sum payment would be for best interests of helper.
